{"id":3129,"date":"2016-02-09T01:02:18","date_gmt":"2016-02-09T01:02:18","guid":{"rendered":"https:\/\/caps-web.org\/?p=3129"},"modified":"2019-04-08T01:08:50","modified_gmt":"2019-04-08T01:08:50","slug":"caps-pet-shop-ordinance-passes-3-2-in-sarasota-county-fl","status":"publish","type":"post","link":"https:\/\/caps-web.org\/caps-pet-shop-ordinance-passes-3-2-in-sarasota-county-fl\/","title":{"rendered":"CAPS Pet Shop Ordinance Passes 3-2 in Sarasota County, FL"},"content":{"rendered":"<p>The Sarasota County ordinance banning the retail sale of dogs and cats passed 3 \u2013 2 Wednesday, January 27, after a very long day of testimony.\u00a0 Opponents testifying against the ordinance included numerous Amish breeders who came from Ohio, Petland franchise owners from Florida and other states, and Midwest brokers and breeders. CAPS President Deborah Howard testified in support of the ordinance. Her testimony dealt with CAPS\u2019 evidence from our undercover investigations of The Hunte Corporation in Missouri, Gary Felts, who owns a puppy mill in Iowa and Virginia Obermiller, a kitten mill operator in Nebraska.<br \/>\n<span id=\"more-2385\"><\/span><\/p>\n<p>CAPS met with commissioners in April 2011 to propose this ordinance. Per the request of the county\u2019s attorney\u2019s office, CAPS provided a detailed legal memo that outlines Florida and federal constitutional law that supports the enactment of the county\u2019s ordinance.<\/p>\n<p>As the leader in the pet shop ordinance movement, CAPS was behind ordinances in West Hollywood, Glendale, Los Angeles and San Diego, California. Our Sarasota County ordinance draft was based on these ordinances. CAPS is also responsible for or assisted with ordinances in Illinois and New York.<\/p>\n<p>The investigatory evidence we provided Sarasota County proved that breeders and brokers selling to Sarasota Petland are known puppy and kitten mills or obtain their animals from known mills.<\/p>\n<p>CAPS stands behind the county in the enforcement of an ordinance \u2013 the owner of Sarasota Petland\u00a0 has already threatened to sue the county \u2013 as we have done with other municipalities. In Cook County, Illinois and New York City, CAPS provided legal expertise and pleadings that enabled these municipalities to successfully defend legal challenges to their ordinances.<\/p>\n<h2>CAPS Investigation of Hunte Corp. (broker to Sarasota Petland)<\/h2>\n<h2><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-2387\" src=\"https:\/\/caps-web.org\/images\/wordpress\/uploads\/2016\/02\/6ed733f4-2513-4250-887c-bb85b2d19f63-300x141.jpg\" alt=\"6ed733f4-2513-4250-887c-bb85b2d19f63\" width=\"300\" height=\"141\" \/><\/h2>\n<p>Why is CAPS so familiar with the brokerage industry, in particular The Hunte Corporation? A CAPS investigator worked at Hunte for six months and investigated some of the breeders selling to Hunte. We have two documentaries on our website:<br \/>\nHunte Corporation \u2013 From Puppy Mill to Pet Shop<br \/>\nUndercover at the Hunte Corporation<\/p>\n<h2>CAPS Investigation of Dwayne Hurliman, a USDA-licensed dog breeder in Oklahoma (sells to Sarasota Petland via Hunte)<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-2388\" src=\"https:\/\/caps-web.org\/images\/wordpress\/uploads\/2016\/02\/b01d8b9c-e443-4ba0-a7f2-f367aece8c09-300x168.png\" alt=\"b01d8b9c-e443-4ba0-a7f2-f367aece8c09\" width=\"300\" height=\"168\" \/><\/p>\n<p>CAPS recently investigated Dwayne Hurliman\u2019s USDA-licensed facility (1,000 adult dogs, 150 puppies) in Oklahoma.\u00a0 Hurliman\u2019s mill had overcrowding, dogs too large for their cages, damaged, bent cages, fecal accumulation, and badly stained cage wire flooring.<\/p>\n<p>The Hurliman report and video on our website:<br \/>\nDwayne Hurliman Report<\/p>\n<h2>CAPS Investigation of Claudia Obermiller, a USDA-Licensed Cat Breeder in Nebraska<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-2389\" src=\"https:\/\/caps-web.org\/images\/wordpress\/uploads\/2016\/02\/7abd024a-ac36-4a29-b261-01c096afc505-300x168.png\" alt=\"7abd024a-ac36-4a29-b261-01c096afc505\" width=\"300\" height=\"168\" \/><\/p>\n<p>CAPS\u2019 recent undercover investigation of Claudia Obermiller\u2019s USDA-licensed facility in Nebraska (28 adult cats, 15 kittens) uncovered substandard conditions \u2013 untreated eye infections, stained floors, fecal and fur accumulation, and filthy litter boxes.<\/p>\n<p>Sarasota Petland sells Obermiller\u2019s kittens. She sometimes sells through Nebraska broker Pixie Pals (owner: Becky Busboom), a supplier to Sarasota Petland.<\/p>\n<p>The Obermiller investigation report and video are on our website:<br \/>\nClaudia Obermiller Report<\/p>\n<h2>CAPS Investigation of Gary (Gerhard) Felts, a USDA-Licensed Dog Breeder in Iowa<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-2390\" src=\"https:\/\/caps-web.org\/images\/wordpress\/uploads\/2016\/02\/f8c4807b-c386-4ad3-94fa-85e7a54746f9-300x168.png\" alt=\"f8c4807b-c386-4ad3-94fa-85e7a54746f9\" width=\"300\" height=\"168\" \/><\/p>\n<p>CAPS\u2019 recent investigation of Gary Felts\u2019 USDA-licensed facility in Iowa (167 adult dogs and 30 puppies) revealed fecal accumulation and insufficient shelter from the elements. Felts told our investigator that he likes to get paid by cashier\u2019s checks or money orders. Sarasota Petland sells Felts\u2019 puppies. Felt\u2019s broker: Pixie Pals. His veterinarian: Dr. Al Beukleman, a licensed dog breeder who also sells to Sarasota Petland.<\/p>\n<p>USDA cited Felts for a number of serious violations between 2006 and 2009, fining him nearly $19,000 in June 2010, a sum the agency is still trying to collect despite a garnishment order in March 2015. Felts\u2019 CVIs, signed by Dr. Beukelman, show the following: Felts is using the first name of\u00a0<b><i>Gerhard<\/i><\/b>\u00a0with a PO Box in\u00a0<b><i>Nebraska<\/i><\/b>.
